What is Criminal Procedure Code 1973

Criminals or offenders are punished according to law and the machinery in India to punish them is enshrined in Criminal Procedure Code 1973. It is a procedural law or an adjective law and it provides machinery for the punishment of the wrong doers.


What is the structure of Criminal Procedure Code 1973


Initially the Criminal Procedure Code contains 484 sections and 2 schedules. After many amendments, as of today the code contains 523 sections and 2 schedules. These sections are all categorized into chapters and they are 37 in number.

Chapter 1 of Criminal Procedure Code 1973 deals with the Preliminary

Chapter 2 of Criminal Procedure Code 1973 deals with the criminal courts and their constitution

Chapter 3 of Criminal Procedure Code 1973 deals with the power of the courts

Chapter 4 of Criminal Procedure Code 1973 deals with the police officers. The powers of the police officers and the aid to the magistrate and the police officers are enshrined in here.

Chapter 5 of Criminal Procedure Code 1973 deals with the Arrest of a person. Arrest of a person and subsequent procedures are enshrined in this chapter.

Chapter 6 of Criminal Procedure Code 1973 deals with process to compel appearance in court on the day of hearing of the case. This chapter contains information about the warrant to arrest, summons, proclamation and attachment and other procedures.

Chapter 7 of Criminal Procedure Code 1973 deals with procedures to compel the production of things before court on the day of hearing of the case. It deals with search warrants, summons to produce, etc.

Chapter 7A of Criminal Procedure Code 1973 deals with procedure for attachment of property and forfeiture of property.

Chapter 8 of Criminal Procedure Code 1973 deals with procedures related to security for maintaining peace.

Chapter 9 of Criminal Procedure Code 1973 deals with issues related to maintenance of wives, maintenance of children and maintenance of parents.

Chapter 10 of Criminal Procedure Code 1973 deals with maintenance of public order. It contains the issues like unlawful assemblies, nuisance in public, etc. It also contains issues related to disputes of immovable property.

Chapter 11 of Criminal Procedure Code 1973 deals with police preventive action.

Chapter 12 of Criminal Procedure Code 1973 deals with police investigation and information to the police regarding an offense.

Chapter 13 of Criminal Procedure Code 1973 deals with Criminal Courts jurisdiction regarding their power to inquire and trials subsequently.

Chapter 14 of Criminal Procedure Code 1973 deals with initiation of proceedings and conditions for doing the same.

Chapter 15 of Criminal Procedure Code 1973 deals with complaints to the magistrate.

Chapter 16 of Criminal Procedure Code 1973 deals with commencement of the proceedings in front of the magistrate.
